8. Governing Law & Disputes

8.1 Governing Law

These Terms are governed by the law applicable to the operator and the Service, without limiting any mandatory consumer-protection rights that apply in a user's country of habitual residence. Nothing in these Terms excludes rights or legal protections that cannot lawfully be waived.

8.2 Dispute Resolution

  1. Step 1: Informal negotiation (30 days good-faith effort)
  2. Step 2: Mediation (if negotiation fails)
  3. Step 3: Any dispute shall be brought before the competent courts determined by applicable mandatory law. These Terms do not override mandatory consumer venue rights.

11.1 Nature of the Analysis

OddsAccuracy provides comparative statistical analysis derived exclusively from publicly available odds data, historical match results, and standard scoring methodologies (including the Brier Score, moving averages, and probabilistic accuracy models). All accuracy scores, rankings, operator comparisons, and commentary represent mathematical computations, analytical interpretations, and research-based opinions—not factual assertions regarding the internal operations, competence, or commercial performance of any bookmaker.

11.2 No Representation of Bookmakers

OddsAccuracy does not represent, rate, certify, or grade any bookmaker in a commercial or qualitative sense. We do not make claims of superiority, inferiority, wrongdoing, negligence, financial status, service quality, or regulatory compliance of any operator. References to bookmakers (e.g., Pinnacle, Bet365, Bwin, William Hill, BetVictor) are for comparative analytical purposes based solely on publicly available odds.

11.3 European Union Legal Context

Article 11 of the Charter of Fundamental Rights of the European Union protects freedom of expression and information, including the freedom to hold opinions and to receive and impart information and ideas. Depending on the context, Directive 2006/114/EC may also be relevant where content qualifies as comparative advertising. These rules are context-dependent and do not create automatic immunity for any particular statement or comparison.

11.4 England & Wales – Honest Opinion

Section 3 of the Defamation Act 2013 provides a defence of honest opinion in England and Wales when its statutory conditions are met, including that the statement is one of opinion and that the basis of that opinion is indicated. Whether the defence applies depends on the facts, wording, evidence, and law applicable to the publication at issue.

11.5 United States – Expression & Fair Use Context

In the United States, constitutional protections for expression and copyright fair use are separate legal concepts. Section 107 of the U.S. Copyright Act identifies purposes such as criticism, comment, scholarship, and research among the contexts considered under the fair-use analysis, but no such purpose automatically makes a use fair. Any protection depends on the applicable law and the specific facts, including the statutory fair-use factors where copyright is involved.

11.6 No Intent to Harm Reputation

OddsAccuracy does not intend to damage the reputation of any bookmaker nor interfere with commercial activity. All comparisons and rankings are automatically generated using transparent formulas and publicly documented methodologies. Operators who disagree with any statistical result may provide clarifying information, which we may evaluate voluntarily without obligation.

11.7 Methodology-Based Interpretations

Accuracy metrics depend on available datasets, probabilistic functions, and contextual factors. They do not represent an operator’s true predictive skill, business quality, strategic competence, or internal modeling capabilities. They reflect the mathematical behavior of implied probabilities over time.

11.8 No Affiliation or Endorsement

OddsAccuracy is an independent entity. We are not affiliated, endorsed, sponsored, partnered, or otherwise connected with any bookmaker unless explicitly disclosed. Operator names and trademarks are referenced strictly for indexing, comparative analysis, and informational use consistent with global standards for editorial and analytical practice.

11.9 User Interpretation & Responsibility

Users acknowledge that all analytics offered by OddsAccuracy represent probabilistic evaluations and that such evaluations carry inherent uncertainty. Users are solely responsible for how they interpret and apply the information presented.
